Can I Use My South Park Condo as a Short-Term Rental in Charlotte?
You may be able to, but the city is rarely the real obstacle. Your condo association usually decides whether short-term rentals are allowed, and the taxes and insurance rules decide whether the numbers work. Read the recorded declaration before you buy or list, because one line can end the plan.
Quick Answer: One third-party guide, last updated August 24, 2026, says Charlotte does not require a short-term rental permit for whole-home rentals, while condo and HOA documents can ban stays under 30 days. A South Park condo owner should read the recorded declaration, confirm state and county tax rules, and check insurance before listing. Jennifer Ledford of The Ledford Group at eXp Realty recommends doing that before an offer, not after closing.
I'm Jennifer Ledford with The Ledford Group at eXp Realty. South Park is one of my lead markets, and investors ask me about short-term rentals more than you'd think. This post is market-report style on purpose. I'm not an attorney or a tax advisor, so treat this as a checklist of questions for the city, the county, your association, your insurer, and a North Carolina attorney.
What does the City of Charlotte require for a short-term rental?
The best summary I found is a third-party guide from BNBCalc, updated August 24, 2026. It says Charlotte requires no short-term rental permit, license, or registry for a whole-home rental. It cites a North Carolina law, G.S. 160D-1207(c), that limits cities from requiring rental owners to register.
It also says the city's Unified Development Ordinance has no short-term rental use as such, and that a whole-home rental is treated as a residential use. A bed and breakfast is a different use, with rules such as owner-occupancy and a limit on guest rooms and stay length.
Because that guide is not an official source, I'd confirm with the City of Charlotte planning staff before you rely on it. Rules can change, and a recent bill in the legislature (Senate Bill 291) could change who sets them. As of that guide, its last action was a committee referral in March 2025.
Can my condo association ban short-term rentals?
Yes, and for a South Park condo, this is the question that matters most. The city does not control private covenants, condo declarations, or leases. The BNBCalc guide notes that many communities bar rentals under 30 days.
Here is what to read, in this order:
1. The recorded declaration and every amendment, and not just the summary in the listing.
2. The rules and regulations, which may add minimum lease terms.
3. Any rental cap, approval process, or fee for leasing.
4. The fines section, so you know what a violation costs.
5. The most recent board minutes, which can show whether the board is discussing changes.
Ask for these in writing before you make an offer. If the association bans short stays, that's not a problem you can fix with a clever listing. It's a different investment. A 12-month lease may still be allowed, and that can be a fine plan, but the income picture changes.
What taxes apply to a short-term rental in Charlotte?
The guide says sales tax and a Mecklenburg County room occupancy tax can both apply to stays under 90 days, and that platforms like Airbnb and Vrbo don't qualify for the small-rental exemption. It lists a combined sales tax rate of 8.25% effective July 1, 2026, and a county occupancy tax of 8%. It also says it could not verify the county's 8% figure.
Because of that, I won't quote a total as fact. Ask the North Carolina Department of Revenue and the Mecklenburg County Office of Tax Administration for the rates that apply to your address, and ask whether the platform collects any of them. Then ask who files and when.
One more point for investors. Taxes on gross receipts reduce your net, so run your numbers after tax, not before.
What about insurance and financing?
A standard condo policy or a landlord policy may not cover guests who pay by the night. Ask your insurer directly, and get the answer in writing. Also ask about liability limits.
Financing matters too. Loan terms can depend on whether the property is your primary home, a second home, or an investment, and lenders can treat short-term rentals differently from long-term ones. Talk to your lender before you write an offer, so you don't find out at closing.
Do the numbers work in South Park?
I'm not going to give you an income number, because I don't have verified booking data for a South Park unit and I won't make one up. What I'd do is build a simple model with real inputs:
- Actual nightly rates and occupancy for comparable units, from booking data you can verify.
- Cleaning, supplies, and turnover cost per stay.
- Association dues and any special assessments.
- Taxes on gross receipts.
- Platform fees.
- Insurance.
- Furniture and replacement cost.
- Mortgage payment at a quote you've received. Freddie Mac's 30-year average was 7.40% on October 8, 2026, though investment loans can cost more.
Then compare that result with a plain 12-month lease. If the short-term plan only beats the long-term plan in a perfect year, I'd treat it as too risky.
Demand drivers like South Park Mall, Phillips Place, and the Morrison Boulevard dining corridor are real, but they don't guarantee bookings. Test your numbers against what comparable units earn.
What should I do before I buy a South Park condo for this purpose?
1. Get the declaration, amendments, and rules before you make an offer.
2. Ask the association in writing whether stays under 30 days are allowed.
3. Confirm tax registration and rates with the state and county.
4. Get an insurance quote that names short-term rental use.
5. Talk to a lender about loan terms for your intended use.
6. Run a simple model against a 12-month lease.
When I work with an investor, the Committed Client Method means the research comes before the tour. I'd rather tell you on day one that a building doesn't allow what you want than let you find out after your due diligence fee is gone.
Frequently asked questions

Can a condo association in South Park ban Airbnb? Yes. Condo declarations and rules are private, and many communities limit rentals under 30 days. Read the recorded declaration and every amendment before you buy.
What taxes apply to a short-term rental in Charlotte? State sales tax and a Mecklenburg County room occupancy tax can apply to stays under 90 days. Confirm current rates with the North Carolina Department of Revenue and the county.
